Fernando’s practice has a particular emphasis on the data center and subsea cable sectors. In the subsea sector, Fernando has represented clients with respect to many of the world's most significant and impactful subsea cable system builds, spanning the globe. His involvement with these systems is often long term, spanning from project inception (including money raising (debt and equity) and consortium formation) through construction to commercialization.
Fernando counsels his clients on all matters related to system builds, including cable supply contract negotiations; system construction and implementation issues; construction and maintenance agreements or joint built agreements for consortium-owned cable systems; landing party arrangements; associated data center and cable landing station buildouts and colocation arrangements; fiber and capacity sales; and related regulatory and network security matters.
In the data center sector, Fernando focuses on the development, construction and operation of data centers and hybrid cable landing stations, often times for use by one or more hyperscalers or subsea cable consortiums. Fernando’s work in this sector includes representation on the procurement of fiber connectivity to data centers, build-to-suit and sale-IRU/leaseback arrangements, unique colocation arrangements and specialized access, security and environmental arrangements and requirements.
Counsel to Meta Platforms, Inc. as to numerous significant transpacific, transatlantic and regional subsea cable systems throughout the globe.
Counsel to two of Europe’s largest carriers as to all facets of their construction, development, commercialization and operation of subsea and terrestrial fiber optic networks globally.
Counsel to two of the lead developers of the CELIA subsea cable system, which, when completed, will connect locations throughout the Caribbean and the United States.
Counsel to principal developer of the Carnival Submarine Network-1 (CSN-1), which, when completed, connect Ecuador, Panama, Colombia, locations throughout the Caribbean and the United States.*
Counsel to one of the lead developers of the SEA-US subsea cable system (connecting Indonesia, the Philippines, Guam, Hawaii and California), including as to related financing.*
Counsel to lead developer of the GBI subsea cable system (connecting the Gulf region countries), as to the supply contract and associated build and development matters.*
