  • obtaining the first Supreme Court judgement on the newly introduced German discovery regime for antitrust damages;
  • successfully represented an airline company (a non-addressee) in relation to actions for damages brought before the Courts in Amsterdam further to a cartel decision taken by the European Commission.

Representative experience

US: Successfully defended Louisiana Children’s Medical Center against the FTC in ground-breaking and closely watched litigation that will redefine the limits of state action immunity from the antitrust laws.

US: Represented Viatris, a leading global pharmaceutical and healthcare corporation, in a series of antitrust cases brought by 49 US states and territories alleging price-fixing and market allocation for hundreds of generic pharmaceutical products.

US: Secured summary judgment for our client Agri Stats, Inc. in In re Broilers Antitrust Litigation in the Northern District of Illinois.

UK: Defending Royal Mail in a high value abuse of dominance claim brought by Whistl, and a related class action in the Competition Appeal Tribunal, in relation to end-to-end bulk mail delivery.

UK: Defending a cryptocurrency exchange, against an industry first class action filed at the Competition Appeal Tribunal on behalf of the UK investors in Bitcoin.

NL: Act as second opinion counsel to a South-Korean manufacturer of electronic products in follow-on damages proceedings before the District Court of ‘s-Hertogenbosch in relation to a cartel decision taken by the Brazilian competition authority.

NL: Defending a client in the energy sector in an action for damages brought before the District Court of Arnhem further to a cartel decision taken by the European Commission.

Germany: Representing a large global technology company in antitrust damages actions in connection with the European Commission's large global technology company Shopping decision.

Germany: Representing a global pharmaceutical company in a dispute with a supplier which refuses to supply production-critical precursors in violation of contract and antitrust law.

Germany: Representing a Big Tech company in antitrust damages actions in connection with a European Commission abuse of decision.

Germany: Enforcement of antitrust damages claims in relation to claims against a supplier arising from a European Commission from decision.
