Working with the ACLU’s Capital Punishment Project

After five years of dedicated advocacy, working with the ACLU’s Capital Punishment Project, the teams, constitutional challenge to the death penalty in Kansas has concluded.

The litigation helped spare the lives of multiple death row clients, who ultimately received plea deals. A judge acknowledged our extensive expert testimony and quoted Justice Brennan’s powerful words from Furman v. Georgia,. This signaled the potential for continued progress in the fight against the death penalty:  “To identify before the fact those characteristics of criminal homicides and their perpetrators which call for the death penalty, and to express these characteristics in language which can be fairly understood and applied by the sentencing authority (juries), appear to be tasks which are beyond present human ability.”
