The International Arbitration team, led by partners Ben Hornan and Annabel Maltby, was recognized for securing a US$153 million London Court of International Arbitration award for longstanding client Madison Pacific against two Ukrainian businessmen who had guaranteed a loan granted to the company they had founded which (among other things) operated a grain terminal at the port of Odesa. The borrower’s default and subsequent enforcement action taken by Madison Pacific led to a multi-jurisdictional dispute involving ancillary proceedings in Cyprus, Dubai, Ukraine and Switzerland. The Hogan Lovells team leveraged the coercive powers of the English courts (which exercised supervisory jurisdiction over the arbitration as it was seated in London) to obtain worldwide freezing orders against the businessmen to prevent the dissipation of assets pending the issuance of the arbitral award – the WFO work was led by partner Oli Humphrey.
