Hans Hertell is a proven, decade-plus, first-rate litigation and arbitration partner, handling a variety of domestic and international business, intellectual property, media law and First Amendment disputes. Hans is a leading attorney in sports, media and entertainment, with a dual focus in intellectual property disputes and transactions.

Hans has deep experience in media, sports, and entertainment law, with a dual focus on disputes and transactions in this industry. He regularly represents Grammy-winning artists, global hospitality, and F&B brands in acquiring, protecting, and monetizing their IP assets. Clients rely on his guidance to manage and enforce trademark portfolios, license valuable content, and navigate the intersection of creative rights and commercial growth.

Complementing his disputes practice, Hans is a seasoned international arbitration practitioner. Originally from Puerto Rico, he brings a unique multi-lingual offering to cross-border matters, including disputes and investigations. He has led arbitration proceedings in foreign languages and under the auspices of leading arbitration centers, including the ICC, AAA/ICDR, ICSID, and JAMS, as well as numerous court proceedings to enforce arbitral awards.

Hans served as a Law Clerk with the U.S. District Court for the District of Puerto Rico, for the Honorable Judge Juan M. Pérez-Giménez. In addition, he completed an internship during law school with the U.S. Court of Appeals for the First Circuit, for the Honorable Judge Juan R. Torruella, and a White House internship during his undergraduate studies. 

Hans currently serves the Co-Chair of the Miami Scores (powered by Concacaf), a non-profit organization that seeks to empower youth with free after-school soccer and literacy program.

Representative experience

Advised live events company regarding a dispute with co-producer of a series of concerts for a renowned musical artist.

Advising numerous F&B companies in disputes related to distribution and supply agreements. 

Secured favorable settlement for Univision and its news anchor, Jorge Ramos, of defamation claims filed in Florida State Court.

Issued successful takedowns of copyright and trademark infringing content under the DMCA and rights of publicity for IP owners, public figures and personalities.

Advising on ongoing disputes in international JAMS arbitration between a premium spirits brand and its U.S. importer.

Advising clients in numerous enforcement proceedings for arbitral awards exceeding $100 million in totality.

Advising a foreign bank in a complex cross-border RICO and fraud claims against prior bank owners and directors.

Advising a sovereign state in seeking compensation arising from injuries related to criminal conduct by a former government official. 

Secured a successful resolution of labor and shareholder disputes between sugar trading company and former head trader.

Secured a favorable settlement of breach of contract claims for a blockchain technology company against an independent producer of television content for online streaming related to an NFT project.

Secured favorable settlement for plaintiffs in a complex $100m fraud case in Puerto Rico federal district court alleging violations of the RICO act/breach of fiduciary duties against defendants.

Successfully represented a Spanish language television company in a copyright infringement jury trial in Miami federal court awarding zero damages against a claim of $8m in damages.

Successfully represented a Spanish language radio company in a copyright infringement bench trial in a New York federal court awarding zero damage plus attorneys’ fees.

 

Advised musical artists and producers in various recording, production, and digital content monetization agreements. 

Advised songwriters/music producers in the sale of their music catalogue to a private-equity backed buyer and accompanying music production agreement for new music.

Advising numerous F&B clients in distribution, supply, trademark licensing and a variety of other commercial agreements. 

Advised global Michelin-star restaurant and hospitality group in management and brand license agreements across its U.S. and international portfolio. 

Advised a foreign spirit producer in sponsorship and endorsement deals with athletes, actors, and other talent, in connection with marketing, sporting/live events, and social media activity.

Advised a Florida manufacturing company in exclusive licensing agreement to manufacture small to medium electrical appliances for global consumer products brand. 

Advised on IP and trademark prosecution strategy and portfolio management for a global hospitality group, private university system, and other media and technology companies.
