For nearly twenty-five years, Allen Pegg, a partner and the Chambers-rated head of the Miami office's litigation team, has concentrated his practice in complex litigation, arbitration, and appellate work.

Allen regularly represents some of the country's most well-known companies in complex matters, and Allen’s clients consistently rely on his judgment and broad range of experience to help them successfully resolve those matters - at whatever stage needed.  Whether involving disputes arising from healthcare or financial services, business torts, class action defense, or corporate governance issues, clients turn to Allen as a trusted advisor. Among his specialties, Allen regularly represents some of the nation’s largest health insurers in suits challenging out-of-network payments, claims processing, other payment practices, ERISA, fraud, and various manners of alleged contract claims.

Regardless of the forum, Allen approaches each case with a unique perspective on how best to tailor his strategy to accomplish his client's particular goals. He has first-chaired numerous jury trials, bench trials, and arbitral hearings, and has briefed and argued dozens of appeals in state and federal courts.

Allen is regularly regarded as a top practitioner in commercial litigation by various publications, including Chambers, Best Lawyers in America, Florida Super Lawyers, and the South Florida Legal Guide.

Allen is also continuously giving back to the community. He regularly handles an array of pro bono matters, and for more than a dozen years, Allen has been a member of the federal appellate list for Criminal Justice Act appointments.

In 2010, Allen was appointed to the Southern District of Florida's Local Rules Committee, on which Allen has served ever since.

Previously, Allen served as a judicial clerk to the Honorable Donald M. Middlebrooks, U.S. District Court for the Southern District of Florida, and to the Honorable Rosemary Barkett, U.S. Court of Appeals for the Eleventh Circuit.

Representative experience

First-chaired two-week arbitration hearing for health plan in successful defense of claims brought by a large hospital system that sought more than $110 million in damages across a myriad of claims.

 

First-chaired state-court jury trial in defense of claims arising from large real estate dispute, resulting in complete defense verdict and no appeal being taken.

First-chair trial counsel for insurance broker in action against former CEO for breach of fiduciary duty, securing $6 million judgment following two-week trial and defense of that judgment on appeal.

First-chaired jury trial for international client pressing claims stemming from collateralized business loan gone sour, resulting in unanimous verdict in client’s favor and no appeal being taken.

Represented founder & CEO of international consumer products brand in variety of complex disputes, including first-chairing multiple trials and final two-week jury trial upheld on appeal.

First-chair trial counsel for national real estate developer in defense of action brought by business partner claiming millions in damages for alleged uncompensated work on behalf of the partnership.

First-chair trial counsel for developer of luxury community in defense of action brought by seller of development rights seeking significant additional compensation, resulting in full defense verdict.

Secrured denial of class certification after multi-day evidentiary hearing on behalf of several Medicaid Managed Care Organizations in statewide class action challenging interest calculations.

 

Representation of multiple domestic and international clients across a variety of industries in defense of significant claims brought under the Helms-Burton Act.

Represented accounting firm in federal action alleging US$175m in aiding and abetting liability brought by unsecured lender arising from historic Ponzi scheme.

Lead counsel for large defense group in action challenging payment practices for emergency fixed-wing air ambulance services, securing complete win on jurisdictional and federal preemption grounds.

 

Representation of large financial institution in defense of multiple putative nationwide class actions alleging improper collection of international transaction fees and fraudulent loan practices.

 

Successful defense of nationwide loan servicer in federal putative class action challenging collection of post-acceleration late fees.

Represented regulated public utility in five consolidated putative shareholder class actions challenging terms of large proposed merger, securing complete dismissal.
